Website terms of use
Ivy Grey Ltd trading as IvyGrey
These terms explain how you may use www.ivygrey.africa and contact IvyGrey through the website. They apply to website use and enquiries. Paid client work is governed by a separate Master Services Agreement and the approved quotation, scope of work or other Project Order.
1 About IvyGrey
The website is operated by Ivy Grey Ltd, trading as IvyGrey, in Nairobi, Kenya. You can contact us at hello@ivygrey.africa, +254 722 542 935, or P.O. Box 5257–00100, Nairobi, Kenya.
2 Website information
Our website describes the services we offer and examples of our work. It provides general information, not a project-specific recommendation or a binding offer to deliver every service listed. Any published fee or indicative timeline is subject to the stated conditions and the scope agreed for the assignment. We take reasonable care with the information we publish and welcome reports of errors.
3 Enquiries and complimentary meetings
Sending an enquiry, requesting a meeting or discussing a project does not require you to purchase services and does not by itself commission paid work. Meetings are subject to availability and confirmation.
We offer one free introductory call of up to 30 minutes per prospective client. Where a fuller discussion is useful, we can arrange one free first discovery meeting of up to 60 minutes, by phone or in person within Nairobi. These conversations help us understand your needs and decide the next step; they do not include a completed strategy, research assignment or creative production. Any paid consultation or expenses will be disclosed and agreed in writing beforehand.
Please tell us promptly if you need to cancel or reschedule. If you request a meeting on behalf of an organisation, provide accurate details and make clear the capacity in which you are contacting us.
4 Commissioning services
Paid work begins only after the applicable agreement, scope, approvals and payment or credit arrangements have been satisfied. Deliverables, fees, taxes, revision allowances, timelines, cancellation provisions and intellectual-property rights are determined by those engagement documents. These website terms do not amend an existing signed client agreement. If there is a conflict concerning paid work, the applicable engagement documents take precedence.
5 Research and results
Research cited on the website relates to the populations, periods and methods described by its source. It is not a forecast for your business. Portfolio examples describe particular assignments and do not guarantee the same outcome for another client. We do not promise specific sales, profitability, search rankings, AI recommendations or audience growth through use of this website or an introductory conversation.
Website content and responsibilities
6 Ownership and permitted use
Website text, design, photographs, films and other materials belong to IvyGrey or their respective owners and are protected where applicable by intellectual-property law. Client names, marks and portfolio materials remain subject to the rights of their owners. Their appearance does not mean IvyGrey owns the client’s business or has a continuing endorsement or partnership.
You may view the website, share links to its public pages and retain a reasonable copy of information for evaluating our services. A downloadable resource may carry its own usage conditions. Except where the law permits otherwise, do not copy, adapt, republish, sell, license or use our creative work or portfolio materials commercially without the relevant owner’s permission. Nothing here restricts lawful quotation, fair dealing or other statutory exceptions.
7 Responsible use
Do not use the website to submit unlawful material, impersonate another person, send spam, infringe rights, introduce malicious code, interfere with its operation or attempt unauthorised access. Send only information you are entitled to share. Please do not include passwords, identity documents, sensitive personal information or confidential client datasets in an initial enquiry. If a project needs confidential materials, we will agree a suitable way to receive them.
8 Privacy and external services
Our Privacy Policy explains how we handle personal information connected with the website and enquiries. It does not replace any separate processing arrangement needed for client work. Links to third-party websites and services are provided for convenience or reference. Those providers control their own services, terms and privacy practices. Choosing to contact us through WhatsApp also involves that provider’s service.
9 Availability and liability
We aim to keep the website available and accurate, but access may be interrupted and information may change. We may update or withdraw website material. Take reasonable steps to protect your own devices and verify information before making significant business decisions.
To the extent permitted by law, IvyGrey is not liable for indirect or consequential loss arising solely from use of this website, or for independent third-party services outside our reasonable control. This does not exclude responsibility for our own conduct where the law does not permit exclusion. Nothing in these terms excludes or limits liability for fraud, wilful misconduct, negligently caused personal injury or any other liability or right that cannot lawfully be excluded or limited. Liability for paid client work is addressed in the applicable engagement documents.
10 Questions disputes and changes
Please send website questions or concerns to hello@ivygrey.africa so we can try to resolve them. Kenyan law governs these website terms, subject to mandatory protections that may apply to you. Courts of competent jurisdiction in Kenya may hear disputes, without removing a right to use another forum where mandatory law provides it.
We may revise these terms and will publish the revised version with its date. Changes operate prospectively and do not retrospectively alter signed client agreements. If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law.
